I am a woman standing alone, quietly holding a sign at a small polling location in a red county. They have been yelling at me, insulting me, and making obscene gestures at me. And today one of the county commissioners, who is also running for re-election, and his wife threatened to call the cops on me for excercising my freedom of speech... as THEY were violating at least four penal and election codes. Texas Penal Code § 39.03 — Official Oppression. Statute: A public servant acting under color of office or employment commits an offense if they intentionally subject another to mistreatment or intentionally deny or impede another in the exercise or enjoyment of any right, privilege, power, or immunity, knowing their conduct is unlawful. Texas Penal Code § 36.03 — Coercion of a Public Servant or Voter. Statute: It is an offense to influence or attempt to influence a person exercising their lawful rights or duties through coercion or threats of unlawful harm. Texas Election Code § 32.075(e) — Limitation of Authority. Statute: Election judges and polling site officials explicitly do not have legal jurisdiction or enforcement authority to restrict political activity beyond the statutory 100-foot distance marker from the entrance. Texas Penal Code § 37.08 — False Report to Peace Officer. Statute: A person commits an offense if, with intent to deceive, they knowingly make a false statement or report to a peace officer, law enforcement employee, or emergency dispatcher regarding an alleged crime. #republicansfortalarico #jamestalarico #texas #voteblue #bluewave @James Talarico @Team Talarico @Texas Democratic Party @Democrats @TheLincolnProject @Headquarters @MeidasTouch
